• Distribute malware, viruses, or other harmful code

Your Content

You retain ownership of all content you upload to our services. By uploading content, you grant us a limited license to store, process, and display your content solely as necessary to provide our services to you.

You are responsible for ensuring you have the rights to upload and share any content you store with us.

Service Plans and Billing

Access to our services is subject to the terms of your selected service plan. Fees are charged in Canadian Dollars (CAD) and are subject to applicable taxes. You agree to pay all fees associated with your account.

We may change our fees upon 30 days notice. If you do not agree to fee changes, you may cancel your subscription before the changes take effect.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to our services. We may suspend services temporarily for maintenance, updates, or circumstances beyond our control.

Data Security

We implement industry-standard security measures to protect your data. However, no method of transmission or storage is completely secure. You acknowledge that you upload content at your own risk.

Termination

You may terminate your account at any time by contacting us. We may terminate or suspend your account if you violate these terms or for other reasons at our discretion.

Upon termination, your right to use the services ceases immediately. We will retain your data for 30 days following termination, after which it may be permanently deleted.

Intellectual Property

The indigo-cliff name, logo, and all related trademarks are our property. Our website content, software, and documentation are protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.

Limitation of Liability

To the maximum extent permitted by law, indigo-cliff shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure.

Indemnification

You agree to indemnify and hold harmless indigo-cliff and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.

Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.

Changes to Terms

We may modify these terms at any time. We will notify you of material changes by posting the updated terms on our website. Your continued use of our services after changes constitutes acceptance of the modified terms.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
